Welcome to Amaia Digital. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or purchasing any of our services, you agree to be bound by these Terms.

Please read these Terms carefully before making a purchase. If you do not agree with any part of these Terms, please do not use our services.

Definitions

- "Amaia Digital," "we," "our," or "us" refers to Amaia Digital and its representatives.

- "Client," "you," or "your" refers to any individual or entity purchasing our services.

- "Services" refers to all products, consultations, courses, and deliverables offered by Amaia Digital.

- "Deliverables" refers to PDFs, documents, and other materials provided as part of our services.

Servicies

Amaia Digital provides digital marketing consulting services, including but not limited to:

- Starter Package: A 90-minute private consultation including your Money Model PDF, Business Social Base PDF, Money Model Cheat Sheet PDF, and lifetime access to the IFC Course (Instagram Followers to Clients).

- Business Package: A 90-minute private consultation including your Money Model PDF, Money Model Cheat Sheet PDF, and lifetime access to the IFC Course.

- Instagram Account Audits: A consultation providing real-time feedback on your Instagram profile.

- IFC Course (Instagram Followers to Clients): A comprehensive 7-module online course with custom GPTs, providing lifetime access and all future updates.

We reserve the right to modify, update, or discontinue any service at any time without prior notice.

Pricing and Payment

Current Pricing

- Starter Package:

Single payment: €647

Payment plan: 2 monthly payments of €500 (total €1,000)

- Business Package:

Single payment: €497

Payment plan: 2 monthly payments of €300 (total €600)

- Instagram Account Audits:

Single payment: €597 (no payment plan available)

All prices are listed in Euros (€) and are subject to change without prior notice. Prices at the time of purchase will be honored for that transaction.

Payment Methods

All payments are processed securely through Stripe. We accept major credit cards and debit cards. We do not accept PayPal, bank transfers, or other payment methods.

Payment Plans

If you choose a payment plan:

- You authorize Amaia Digital to automatically charge your payment method for all scheduled installments.

- The second payment will be automatically charged 30 days after your initial payment.

- You are responsible for ensuring your payment method is valid and has sufficient funds.

- Payment plan pricing includes a surcharge for the convenience of splitting payments.

Late Payments and Non-Payment

If a scheduled payment fails or is not completed on time:

- A late fee surcharge may be applied to your outstanding balance.

- Your access to services and deliverables may be suspended until payment is received.

- We reserve the right to revoke your license to use any deliverables provided until full payment is completed.

- After 30 days of non-payment, your account may be sent to a collections agency.

- We reserve the right to pursue legal action to recover any outstanding amounts.

All deliverables provided by Amaia Digital are licensed, not sold. Your license to use these materials is contingent upon full payment. Use of deliverables without completing full payment constitutes a violation of these Terms and intellectual property law.

Booking and Scheduling

Booking Your Consultation

After payment, you will receive instructions to book your consultation through our online calendar. You are responsible for selecting a time that works for you and providing accurate contact information.

Rescheduling Policy

You may reschedule your consultation up to 3 times at no additional cost, provided you do so at least 24 hours before your scheduled appointment.

If you reschedule with less than 24 hours' notice, fail to attend your scheduled consultation, or reschedule more than 3 times, your consultation will be forfeited and you will need to purchase a new session.

Cancellation by Amaia Digital

We reserve the right to cancel or reschedule consultations due to illness, emergencies, or unforeseen circumstances. If we cancel your consultation:

You will receive a full refund, OR

You will receive priority scheduling for a new appointment

We also reserve the right of admission and the right to refuse service to any client at our sole discretion. If we choose not to provide services to you, you will receive a full refund of any payments made.

Deliverables

Delivery Timeline

- Standard delivery: Deliverables will be sent within 48 hours after your consultation.

- Express delivery (if purchased): Deliverables will be sent within 2 hours after your consultation.

Use of Deliverables

Upon full payment, you receive a limited, non-exclusive, non-transferable license to use the deliverables for your personal or business purposes. This means:

You MAY: Use the strategies, offers, and frameworks created in your Money Model for your own business. Implement the recommendations in your Business Social Base. Reference the materials for your own business decisions.

You MAY NOT: Resell, redistribute, or share the Money Model PDF, Business Social Base PDF, Cheat Sheet PDF, or any other deliverables. Claim ownership or authorship of our materials. Use our materials to create derivative products for sale. Share access to the IFC Course with others.

Any violation of these terms may result in legal action and termination of your license to use our materials.

IFC Course Access

Upon purchase of the Starter Package or Business Package, you receive lifetime access to the IFC Course, including:

- All 7 modules and custom GPTs

- All future updates and improvements at no additional cost

Course Restrictions

Access is granted to you only and may not be shared with others.

Course content may not be downloaded, copied, reproduced, or redistributed.

You may not use course materials to create competing products or services.

We reserve the right to terminate your course access if you violate these Terms.

Guarantee

We offer a satisfaction guarantee on our Starter Package and Business Package:
If, after receiving your final deliverables, you do not feel the value received is worth the price paid, we will convert your payment into store credit of equal value, usable on any Amaia Digital service within 30 days.

How to Claim

To claim the guarantee, simply email us at [email protected] within 30 days of receiving your deliverables. No explanation or justification is required.

Guarantee Conditions

The guarantee does not apply if:

- You fail to attend your scheduled consultation.

- You have not completed full payment (for payment plan customers).

- You request the guarantee after 30 days from receiving your deliverables.

Instagram Account Audits

The Instagram Account Audits service is not covered by the satisfaction guarantee. All sales for this service are final.

Affiliate Program

Amaia Digital offers an affiliate program that allows you to earn commissions by referring new clients to our services.

Commission Structure

- Affiliates receive 50% commission on referred sales.

- Commissions are paid after the 30-day guarantee period has passed.

- For clients who pay in installments, commission is paid only after the client has completed 100% of their payment.

Program Terms

- There is no minimum threshold to withdraw commissions.

- Amaia Digital reserves the right to modify commission rates, program terms, or terminate the affiliate program at any time, with prior payment of any earned commissions owed.

Intellectual Property

All content, materials, deliverables, courses, branding, and methodologies provided by Amaia Digital are protected by intellectual property laws and remain the exclusive property of Amaia Digital.

This includes but is not limited to:

- The Money Model framework and methodology

- The IFC Course content and structure

- All PDFs, templates, and deliverables

- Our website content, design, and branding

You receive a license to use our materials as described in these Terms, not ownership of the intellectual property itself.

Limitation of Liability

No Guarantee of Results

Amaia Digital provides education, strategy, and guidance. We do not guarantee any specific business results, income, or outcomes. Results depend on many factors outside our control, including but not limited to:

- Your individual effort and implementation

- Your industry and market conditions

- Your existing skills and resources

- Economic factors and timing

Any examples of results or earnings mentioned on our website or in our materials are illustrative only and not promises of what you will achieve.

Limitation of Damages

To the fullest extent permitted by law:

Amaia Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Professional Advice Disclaimer

Our services provide education and strategy guidance only. We do not provide legal, financial, tax, or professional advice. You are responsible for consulting with appropriate professionals for specific advice related to your situation.

User Conduct

By using our services, you agree not to:

- Use our services for any unlawful purpose.

- Share your account access or course login with others.

- Attempt to access our systems, accounts, or data without authorization.

- Misrepresent your identity or affiliation.

- Harass, abuse, or harm Amaia Digital representatives or other clients.

- Use our materials to compete directly with Amaia Digital.

We reserve the right to terminate your access to our services if you violate these Terms.

Right of Admission

Amaia Digital reserves the right to refuse service to any individual or entity at our sole discretion. If we choose not to provide services, any payments made will be fully refunded.

Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in our Privacy Policy.

Modifications to Terms

Amaia Digital reserves the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be made without prior notice.

The most current version of these Terms will always be available on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.

It is your responsibility to review these Terms periodically. If you do not agree with any modifications, you must stop using our services.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Luxembourg.

If you are a consumer residing in the European Union, you will also benefit from any mandatory provisions of the consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

If you are a consumer residing in the European Union, you may bring legal proceedings in relation to these Terms either in the courts of Luxembourg or in the courts of your country of residence.

For non-consumer clients (businesses), any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Luxembourg.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Amaia Digital regarding your use of our services.
